Subscription Policy

1. What this policy covers

This policy explains how the monthly plans run: Evolve, Evolve Plus, and the monthly extras for an Origin site, which are hosting, the care plan and the AI chat assistant. They are provided by Ellis Laing trading as LaingLogic, based in Glasgow, United Kingdom.

Read it with my Terms & Conditions and my Refund Policy. Where your proposal says something different from this policy, the proposal applies, unless that would take away a right the law gives you. If you are a consumer, nothing in this policy takes away or limits your statutory rights.

2. What the plans include

Evolve is a website built for your business, then hosted and improved every month. Evolve Plus adds one module at launch (bookings, payments, sign-ups or customer accounts, or a custom feature on a Shopify store), more revision rounds each month and a faster turnaround on changes. The pricing page lists what each plan includes, and your proposal confirms it for your site.

Your site runs either on my own platform or on Shopify, and your proposal records which. On Shopify, your Shopify plan is billed to you by Shopify and is separate from my fee.

3. Billing

  • Fees are billed monthly in advance and are due on the first of each calendar month.
  • Prices are in pounds sterling. I am not VAT registered, so no VAT is added.
  • You can pay by card, taken through Stripe, or by bank transfer.
  • If an invoice is still unpaid 14 days after it is due, I may pause the work, and the hosting of a site I host, until it is paid. I will tell you before I do.

4. The 12-month minimum term

Evolve and Evolve Plus have a 12-month minimum term. It starts on the start date in your proposal, and I ask you to confirm it in writing before any work begins. There is no build fee: the build is paid for across the term, which is why the pricing page shows the total for the first year beside each monthly price.

Your monthly price stays the same for the whole of the minimum term.

5. After the minimum term

When the minimum term ends, the plan carries on month to month at the same price. It does not start a new 12-month term unless we both agree one in writing. From then on, either of us can end the plan at any time with one month's written notice.

6. Price changes

Once the minimum term is over I may change the monthly price. I will tell you in writing at least 30 days before a new price applies, and you can end the plan before then without paying anything more.

7. Ending a plan

  • After the minimum term: one month's written notice, with nothing more to pay.
  • During the minimum term: business clients pay the monthly fees left in the term, and consumers pay a lower early exit charge. Section 6 of the Refund Policy sets out both, with a worked example.
  • Consumers can also cancel within 14 days of agreeing a plan, as section 3 of the Refund Policy explains.
  • Monthly extras have no minimum term and end with one month's written notice.
  • A month that has started is not refunded.
  • If I end a plan for a reason that is not your fault, you pay nothing more and I refund any fees paid for time after it ends. I give you at least 30 days' notice, unless the law requires me to end it sooner.

To end a plan, email enquire@lainglogic.com. I reply within 2 business days to confirm the end date.

8. When a plan ends

On the end date, development, support and access to the client development portal stop. If I host your site, the hosting stops too, so before that date I send you a copy of your site's files and, if you ask, help you move it to a new host. If your site is on Shopify, it stays in your own Shopify account and is not affected.

Once your account is settled in full, including any charge under section 7, the design and code made for your site are yours, in line with the intellectual property terms in my Terms & Conditions.

9. Hosting and availability

Where I host your site, I aim to keep it available and fast, but I cannot promise it will never be interrupted. Planned maintenance, or problems outside my control, can cause short periods of downtime, and I give notice of planned maintenance where I can. Where your site is on Shopify, its availability is Shopify's responsibility under Shopify's own terms, as section 8 of my Terms & Conditions explains.

10. Suspension

I may suspend a plan for non-payment, where it is needed to protect my platform or my other clients, or to comply with the law. I will tell you when it happens and what is needed to restore the service.

11. Governing law

This policy, and any dispute or claim arising out of it, is governed by the law of Scotland, and the Scottish courts (the Sheriff Court or the Court of Session) have jurisdiction, except that if you are a consumer living in another part of the United Kingdom, you may also bring proceedings in the courts of the part where you live.

12. Changes to this policy

I may update this policy. The date at the top of this page shows the current version. A change applies to plans agreed after that date. A plan already running keeps the version you accepted unless we both agree to change it.
